Terms of Service - Azure Event Hubs

Please read these terms of service ("Terms") carefully before using the Azure Event Hubs service provided by Microsoft Corporation ("Microsoft," "we," "us," or "our"). Your access to and use of the Azure Event Hubs service is conditioned upon your acceptance of and compliance with these Terms.

1. Acceptance of Terms

By accessing or using the Azure Event Hubs service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the service.

2. Service Description

Azure Event Hubs is a highly scalable data streaming platform and event ingestion service that can capture, transform, and store millions of events per second. It enables you to process and analyze real-time data streams from various sources.

3. Use of Service

You agree to use the Azure Event Hubs service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use and enjoyment of this service by any third party.

You are responsible for all activities that occur under your Azure account and for complying with all applicable laws and regulations, including those related to data privacy and export control.

Important Note: You must ensure that your use of Azure Event Hubs complies with all applicable data protection laws and regulations in your jurisdiction and the jurisdictions where your data subjects reside. This includes obtaining necessary consents and providing appropriate privacy notices.

4. Intellectual Property

Microsoft retains all right, title, and interest in and to the Azure Event Hubs service, including all intellectual property rights therein.

5. Data Ownership and Privacy

You retain ownership of any data you submit to or process through Azure Event Hubs. Microsoft will only access or process your data as necessary to provide the service or as required by law. For details on how we handle your data, please refer to the Microsoft Privacy Statement and the Azure Subscription Agreement.

6. Disclaimers and Limitation of Liability

The Azure Event Hubs service is provided "as is" and "as available" without warranties of any kind, either express or implied. Microsoft disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Microsoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

7. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.
