Microsoft Windows Software Development Kit License Agreement
This license agreement (the "Agreement") is a legal agreement between you and Microsoft Corporation ("Microsoft") regarding your use of the Microsoft Windows Software Development Kit (the "SDK"). The SDK includes software, documentation, and any related components.
1. Grant of License
Subject to the terms of this Agreement, Microsoft grants you a non-exclusive, non-transferable, royalty-free license to use the SDK solely for the purpose of developing, testing, and deploying applications that run on the Microsoft Windows operating system.
2. Ownership
Microsoft and its suppliers own all right, title, and interest in and to the SDK, including all intellectual property rights therein. This Agreement does not grant you any ownership rights in the SDK.
3. Restrictions
You may not:
- Reverse engineer, decompile, or disassemble the SDK, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
- Modify or create derivative works of the SDK.
- Distribute, sublicense, rent, lease, or lend the SDK to any third party.
- Use the SDK in any manner that violates any applicable laws or regulations.
4. Updates and Support
Microsoft may make updates to the SDK available from time to time. These updates may be subject to additional terms and conditions. Microsoft is not obligated to provide support or maintenance for the SDK.
5. Disclaimer of Warranty
THE SDK IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. MICROSOFT AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MICROSOFT OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA, ARISING OUT OF THE USE OR INABILITY TO USE THE SDK, EVEN IF MICROSOFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. Governing Law
This Agreement shall be governed by the laws of the State of Washington, USA, without regard to its conflict of law principles.
By using the Windows SDK, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
