Azure Terms of Service
These Azure Terms of Service (these “Terms”) govern your use of the Azure services. By accessing or using the Azure services, you agree to these Terms.
1. Use of the Services
You may use the Azure services only for your business or personal use, in accordance with these Terms and applicable law. You may not use the Azure services to:
- Violate any applicable laws or regulations.
- Infringe on the intellectual property rights of others.
- Distribute spam, viruses, or other harmful code.
- Interfere with the operation of the Azure services or the networks connected to them.
Microsoft reserves the right to suspend or terminate your access to the Azure services if you violate these Terms.
2. Data Privacy and Security
Microsoft is committed to protecting your data. Our Privacy Statement explains how we collect, process, and protect your personal data.
You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify Microsoft immediately of any unauthorized use of your account.
3. Intellectual Property
All intellectual property rights in the Azure services are owned by Microsoft or its licensors. You do not acquire any rights to the Azure services other than the limited right to use them as described in these Terms.
You retain ownership of your content that you upload or process using the Azure services. By using the services, you grant Microsoft a limited license to use your content solely for the purpose of providing and improving the services.
4. Payment Terms
You agree to pay all applicable fees for the Azure services you use. Fees are based on your usage and the pricing plans available at the time of use. You are responsible for all taxes applicable to your use of the services.
Microsoft may change its pricing for the Azure services from time to time. We will provide you with notice of any price changes.
5. Disclaimers and Limitation of Liability
The Azure services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Microsoft shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Azure services.
- Any conduct or content of any third party on the Azure services.
- Any content obtained from the Azure services.
- Unauthorized access, use, or alteration of your transmissions or content.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
7. Changes to These Terms
Microsoft may modify these Terms from time to time. We will post the updated Terms on this page and update the “last updated” date at the top. Your continued use of the Azure services after any such modification constitutes your acceptance of the new Terms.
